Thank you for choosing to Mind Flexibility

Your order/booking is subject to the following terms and conditions (unless you have made special arrangements directly with us). Mind Flexibility Ltd reserves the right to alter these Terms and Conditions without prior notice.

 
About these terms

These terms and conditions of sale are applicable to all orders/bookings for PDF’s, CD’s, MP3’s and courses/workshops booked with Mind Flexibility. By placing an order for a product or booking a course/workshop you agree to be bound by and accept these terms and conditions.

The prices displayed on our website are subject to change without prior notice. While we do our best to ensure the prices displayed on our website are correct we reserve the right to correct any such error. Should such an error occur we will notify you prior to any order/booking being accepted or confirmed.

These sales terms do not affect your statutory rights which cannot be waived or limited by contract. 

  1. General Payment

Methods of Payment

Online

We accept orders and course/workshop booking online. Credit/debit card payments on-line via PayPal’s secure online payment system.

 By Phone

Call us on 0845 2340720 or 07912 742180 (8:00am to 8:00pm Monday to Saturday). Please ensure you have your credit card details ready these payments will be processed via PayPal’s virtual terminal.

 By Post
If you would like to send your order by post, simply print out your completed order, course/workshop booking form and send it to the address below. Please include your credit/debit card details, postal order or cheque made payable to Mind Flexibility Ltd and send it to:

If you would like to email your order/booking, simply complete the order, course/workshop booking form and email it to us at shoponline@mindflexibility.com. Please provide a day time contact phone number to enable us to discuss your preferred method of payment.

Price & Payment

  1. All prices are in £ sterling. Delivery charges where applicable are not included in the prices quoted. Please be aware that payments and indeed your order are not processed immediately. Payment details and your order will be subject to scrutiny by Paypal (our credit/debit card security system), our staff and authorisation by the card provider. We reserve the right to cancel any order, course/workshop booking if problems or issues arise. Customers will be notified in any such case. You will not be charged until we have checked all relevant details.
  2. Prices are as stated on our website.
  3. Post and packing charges where applicable are indicated separately on the paper or electronic invoice see delivery charges.

Value added tax

United Kingdom based customers:

Mind Flexibility Ltd VAT registration number is 0000000000 (awaiting VAT number). The price stated on our website is inclusive of any applicable value added sales tax, the breakdown of any applicable VAT payable with your order is indicated on the electronic/paper invoice.

Other customers:

All overseas orders may subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for custom clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Custom policies vary widely from country to country, so you should contact you local Customs office for further information. Additionally, please note that when ordering from Mind Flexibility Online you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods and may be subject to opening and inspection by Customs authorities.

 2.     Course/workshop booking

We will do our best to fulfil your booking within 24 hours. No booking is accepted by us unless until either a deposit has been paid or payment has been received in full. Confirmation of booking will be sent in writing (either by printed invoice, email or other) within 2 working days. For late bookings, the confirmation will be sent via email or post the same working day. Joining instructions will be sent to your email address/postal address at the latest 7 days prior to the course start date. These instructions will contain the full address of the venue and start times for the course.

2.1.                    Payment Terms

2.1.1.        All credit/charge card payments are subject to authorisation by the card issuer. If your payment is not authorised, we will cancel your booking (and notify you that we have done so).

2.1.2.        Early payment discount applies to courses/workshops paid for in full at least 2 calendar months in advance of the course start date.

2.1.3.        All courses/workshops where a deposit has been paid are to be paid in full at least 1 calendar month prior to start date.

2.1.4.        Courses booked less than 1 calendar month prior to start date are to be paid in full at time of booking unless otherwise agreed with management.

2.2.                    Cancellations & Refunds

2.2.1.        Course and date amendments may be accepted without administration charge or penalty.

2.2.2.        Cancellation less than 14 days prior to the due course start date or during the course: any refund is at management discretion.

2.2.3.        Cancellation more than 14 days prior to the course start date will attract a penalty of 30% of course fees or loss of deposit.

2.2.4.        Bookings made less than 7 days prior to the course start date may not be cancelled, except in exceptional circumstances.

2.2.5.        No fees will be returned after course commences.

2.2.6.        Full refund for courses cancelled is at management discretion.

2.2.7.        Any refunds agreed by management will be actioned within 5 working days from the end date of the cancelled course.

2.3.                     Course conduct

2.3.1.        Course materials are owned by Mind Flexibility Ltd until the course is fully paid.

2.3.2.        Course will be carried at all times in civil manner adhering to ethical and disciplined practice.

2.3.3.        Any client breaking conduct rules and causing concerns will be asked to leave the course and under management’s discretion with no need to justify reasoning.

 

3.     PRODUCT orders

We will do our best to fulfil download orders within 24 hours. Postal orders within 5 working days with the UK and within 14 days outside the UK. Our delivery dates are only estimates and can not be guaranteed. No order is accepted by us unless and until payment has been received in full and confirmation has been sent in writing (either by printed invoice, email or otherwise).

3.1.                    Payment terms

3.1.1. All CD/DVD’s PDF’s or other products will be distributed via download or post once payment has been received in full.

3.1.2. All credit/charge card payments are subject to authorisation by the card issuer. If your payment is not authorised, we will cancel your order (and notify you that we have done so) and you must return the goods to us (if you have already received them) at your own expense.

3.1.3. The goods remain our property until you have paid for them.

3.2.                    Title and Risk

3.2.1. If your order is for delivery outside the UK, you are solely responsible for the goods from the time they leave our premises and for the importation of those goods into the country of delivery (including arranging for any necessary legal consents and payment of duties or taxes), and we accept no responsibility for any claims arising from such importation.

3.2.2. If your order is for delivery inside the UK, the risk of loss and/or damage (but not title) to goods supplied by us shall pass to you when they are delivered to you or your nominee and we shall not be liable for the safety of the goods thereafter.

3.2.3. Ownership of all goods shall remain vested in us (and we reserve the right to dispose of the goods) until we have received payment in full of all debts you owe to us.

3.3.                    Cancellation and Returns

3.3.1. If for any reason you are not satisfied with your purchase, you have a right to cancel your contract. In the case of physical product, simply return it to us in its original condition within 28 days from the date of purchase (but no later) and, at your request, we will issue a full refund for the price of the item or supply you with a new one. If the return is the result of our error (including faulty or damaged goods), we will also refund the postage (where applicable). Please enclose either (i) a copy of the paper invoice enclosed with the delivery, or (ii) a print of the online digital receipt. The package should be securely wrapped and sent to:

3.3.2. We will not be responsible for any damage or loss in transit and recommend that you use a recorded delivery service. In the case of digital or electronic product, please contact us as directed below, again within 14 days, and, at your request, we will either provide a replacement or issue a full refund

4.     General

4.1.   We do not make any representation or give any warranty or undertaking as to the quality of the goods, their correspondence with description or fitness for purpose, or that the goods are not defamatory, injurious, obscene or unlawful, or that any trade marks or copyright used on or in connection with the goods do not infringe any intellectual property rights not owned by us.

4.2.   In the case of downloadable electronic products, we do not make any representation or give any warranty or undertaking that the functions of such product being compatible with any computer system on which it is used.

4.3.   You assume responsibility for selecting the product to achieve your intended results.

4.4.   You are not permitted to remove or amend any trade mark, copyright or other proprietary notice on any of our products. You acknowledge that all rights in and to any and all copyrights, know how and other intellectual property rights relating to our products are and shall remain our property.

4.5.   You will not at any time do, or cause to be done, any act or thing which impairs or infringes those rights.

4.6.   These terms and conditions and all purchases under these terms and conditions are governed by and shall be construed in accordance with the laws of England and all disputes shall be submitted to the exclusive jurisdiction of the English courts.

4.7.   We reserve the right to terminate any contract formed under these terms and conditions immediately by written notice and to take action to recover damages suffered by us if you breach any of these provisions.

5. Privacy Policy

The purpose of this privacy statement is to provide you, the User, with details of how Mind Flexibility Ltd will collect, store and use the personal data you supply to it. Personal data is information which relates to identifiable living individuals. This Privacy Policy is expressly incorporated into the Terms and Conditions of Use of this website.

 

5.1.      Statement of Intent

It is the stated policy of Mind Flexibility Ltd that it will act in accordance with current legislation and aims to meet current best practice with regard to the processing of personal data.

5.2.    Collection of Personal Data

In using this site, you may provide certain personal data to Mind Flexibility Ltd. In agreeing to be bound by the Terms and Conditions of the web site (of which this Privacy Policy forms part), you agree that Mind Flexibility Ltd can compile and process this personal data in accordance with this Privacy Policy.

5.3.      Online Forms, Use of Personal Data

Any information that you provide to MindFlexibility.com, for example when requesting course/workshop further details, making a booking/purchase, entering competitions, joining our mailing listing or sending an email query, is captured and stored on our database.

In addition to using this information to fulfil specific customer queries and requests, it also lets us keep you updated with news and promotions concerning Mind Flexibility Ltd, should you wish to opt out from receiving such information please contact us, details can be found on our Contact Us section.

We guarantee that any information you provide to us will not be passed on to our selected partners or third parties agencies.

Please note that this privacy statement applies only to Mind Flexibility Ltd and not to any third-party sites that are linked to from this site.

5.4.       Storage and Correction of Personal Data

Mind Flexibility Ltd will retain the personal data it holds unless and until you send notice that you no longer wish us to retain this data. Mind Flexibility Ltd will not hold any personal account or debit/credit card details on its database. Any such details provided to Mind Flexibility Ltd will be used to process the agreed payment or refund only. On completion of the agreed transaction any such information will be deleted/destroyed.

Mind Flexibility Ltd is obliged to supply you, on request, with a copy of the personal data it holds about you.
